These terms and conditions govern rental of the vehicle described below. Together with the rental contract and its annexes (joint condition reports at pick-up and return, damage diagram, vehicle inventory, claims history declaration, copies of identity documents and driving licences), they form a single indivisible contractual set. Signing the rental contract constitutes unreserved acceptance of these terms and conditions.

Article 1

Purpose and definitions

The lessor rents out a Dreamer brand campervan, Camper Five model, registration 2-JXQ-248, for the period, dates and price agreed in the rental contract.

  • The lessor: Lalouque SRL, trading as Pyja Van, owner of the vehicle and insurance policyholder.
  • The renter: the adult natural person who signs the contract and bears sole financial responsibility.
  • The approved driver: the renter and, where applicable, the second driver expressly named in the contract, both meeting the conditions of Article 3. No other person is authorised to drive.
  • The rental: the period from handover of the keys to their actual return.
Article 2

The vehicle and its use

Campervan 6.36 m long and 2.90 m high, maximum authorised mass under 3.5 tonnes, approved for 5 seated places and 5 berths. It is driven on a category B licence.

The vehicle is rented exclusively for private leisure use. Any professional, commercial, rental or profit-making use is strictly prohibited — this restriction is also imposed by the vehicle's insurer.

The renter acknowledges having received a full handover at pick-up (water, electrics, gas, heating, beds, bathroom).

Article 3

Who may rent and drive

Conditions imposed by the vehicle's insurance contract

They allow no exception: no rental may be concluded and no keys may be handed over if any of them is not met.

3.1. Conditions applying to each driver

  • be over 25 years old on the day of pick-up;
  • hold a full (non-provisional) category B driving licence for at least 5 years, currently valid;
  • have had, in the last 5 years, no more than one at-fault claim;
  • have had no aggravating factor in the last 5 years: driving under the influence of alcohol, drugs, medication or similar substances, or hit-and-run;
  • not have been subject to any disqualification, withdrawal or suspension of the right to drive;
  • not suffer from any condition or physical impairment of a nature that may affect the ability to drive.

3.2. Number of drivers

The vehicle may only be driven by a maximum of two approved drivers, expressly named in the rental contract. Any other person, including a family member or passenger, is strictly forbidden from taking the wheel, even when stationary, even on private land and even in an emergency.

3.3. Documents to provide before pick-up

Each driver provides the lessor with the documents required by the insurer to verify insurability conditions:

  • a double-sided copy of their identity card;
  • a double-sided copy of their driving licence;
  • a signed claims history declaration (annex 4 to the rental contract), by which they declare on their honour that they meet the conditions of Article 3.1.

Originals are presented to the lessor for verification. The lessor is authorised to verify the validity of the identity documents presented with the competent public services.

Any false declaration relating to these conditions engages the renter's liability. Payment of an excess or provision of the security deposit neither covers nor neutralises the consequences of fraud, a false declaration or a breach of insurability conditions. If, because of a fact attributable to the renter or a driver, the insurer refuses or reduces its intervention or brings a claim against the lessor, the renter reimburses the lessor for the amounts actually charged to it and duly substantiated, without the €2,000 security deposit constituting a liability cap.

3.4. Refusal to hand over the keys

The lessor may refuse to hand over the keys, and therefore refuse pick-up, in the following cases:

  • the documents referred to in Article 3.3 are not provided, are incomplete, do not match the persons named in the contract, or their authenticity appears doubtful;
  • one of the conditions in Article 3.1 is clearly not met, or an inaccurate declaration is established;
  • a person not named in the contract presents themselves as a driver;
  • the number of people due to travel on board exceeds the vehicle's 5 belted seats;
  • the announced destination lies outside the geographical area authorised under Article 10;
  • a driver presents themselves in a condition clearly incompatible with driving;
  • the security deposit has not been provided or the balance of the price has not been paid.

Where refusal is based on an established fault of the renter — in particular an inaccurate declaration, missing required documents or failure to pay — the rental is deemed cancelled by the renter and the scale in Article 17.1 applies.

Where an event occurring after the conclusion of the contract means that none of the designated drivers still meets the conditions of Article 3.1, and failing a replacement driver approved by the lessor, the rental is deemed cancelled by the renter on the date on which the lessor is informed. The cancellation scale in Article 17.1 applies.

In all other cases, where the lessor exercises this option as a precaution, without an established fault of the renter, the rental is terminated without compensation on either side and all amounts paid, including the security deposit, are refunded in full to the renter within 14 days.

Article 4

Booking and payment

A date request does not constitute a booking. A booking only becomes firm after written confirmation by the lessor, signing of the contract and receipt of the deposit.

The lessor reserves the right not to follow up on a booking request. For as long as the three conditions above are not met, no contract is formed and the lessor is under no obligation. Any amounts already paid are refunded in full to the applicant within 14 days, with no other compensation on either side.

The lessor has only one vehicle: availability announced on the website or by telephone is indicative and does not constitute a firm offer within the meaning of Article VI.2 of the Code of Economic Law.

Due dateAmount
On booking30% deposit
30 days before pick-up70% balance
Booking less than 30 days before pick-up100% on booking
At the latest 72 hours before pick-upSecurity deposit — transfer received on the lessor's account, from an account opened in the renter's name

If the balance is not paid by the due date, the lessor sends the consumer renter a first free reminder. The renter then has the statutory waiting period of at least 14 calendar days before any financial or compensatory consequence linked to non-payment may be applied. At the end of that period, if payment remains due, the lessor may treat the booking as cancelled by the renter and apply, within the limits permitted by law, the scale in Article 17.1. Payments are made by bank transfer to the lessor's account, with the booking reference in the payment details. The security deposit is paid from a bank account opened in the renter's name. Cash is not accepted.

Article 5

Price: what is included and what is not

5.1. Rate

The rental price is set out in the contract. It is based on a rate of €140 per night, with a minimum of 2 nights, plus a of €75 per trip.

Launch offer: the is free for any booking confirmed before 1 March 2027.

All amounts stated in these terms and in the rental contract are inclusive of VAT. Applicable discounts: 5% from 7 nights, 10% from 14 nights, 10% for pick-up within one week. These discounts do not stack: the most favourable for the renter is applied.

5.2. Included in the price

  • provision of the fully equipped vehicle and its inventory (crockery, camping equipment, table and chairs; detailed list in the annex);
  • 150 km per rental night, cumulative over the whole trip;
  • one gas bottle, whose normal consumption during the trip is included in the price;
  • full handover at pick-up, telephone assistance from the lessor during the trip and the benefit of VAB assistance within the limits of Article 13.4;
  • compulsory third-party liability insurance and comprehensive vehicle insurance, subject to excesses remaining at the renter's expense (Article 13.2);
  • routine cleaning of the vehicle on return ().

5.3. Not included in the price

  • fuel and AdBlue;
  • kilometres beyond the allowance, charged at €0.45 per kilometre;
  • tolls, vignettes, tourist taxes, campsite, service area and parking fees;
  • fines, charges and procedural costs linked to offences;
  • insurance excesses (Article 13.2) and uncovered damage (Articles 13.5 and 16);
  • the renter's personal insurance: legal protection, driver personal accident and personal assistance, which are not covered by the lessor's policies (Article 13.3);
  • optional packs (baby pack, winter pack, etc.) and any supplement agreed in the contract.
Article 6

Security deposit

A security deposit of €2,000 is required at the latest 72 hours before handover of the keys. It covers in particular the comprehensive excess normally applicable during the rental, currently €1,115.70 (2% of the vehicle's value exclusive of VAT, with a minimum of €1,000), as well as damage, supplements and costs remaining at the renter's expense in accordance with the contract and these terms and conditions. It is paid by bank transfer to the lessor's account, from an account opened in the renter's name. No keys are handed over without a deposit in place.

The deposit is not an advance on the price and may not be used to pay all or part of the rental.

If no amount remains due, the deposit is returned within a maximum of 14 days following return of the vehicle and the return condition report. Where a supplement, damage or other amount may be charged to the renter, the lessor informs them as soon as possible, states the reason and provides the supporting information available. The renter has a reasonable period, in principle 14 days from that notification, to submit observations before the contested amount is finally charged.

The lessor may deduct from the security deposit the amount of:

  • excess mileage, missing fuel and flat fees from the rate schedule;
  • the cost of damage noted, or the applicable excess in the event of a declared claim;
  • fines and administrative fees known by that date.

If damage or a claim is noted but its cost is not yet established, the lessor may provisionally retain all or part of the deposit reasonably corresponding to the amount that may be due, for a maximum of 60 days, informing the renter in writing. The unnecessary portion of the deposit is returned without waiting. The amount of the deposit does not limit the renter's liability: if the loss or the amounts actually due exceed it, the balance remains due.

Article 7

Pick-up and return

7.1. Place and times

The vehicle is collected and returned at Orp-Jauche (1350), Walloon Brabant, unless otherwise agreed in writing. Pick-up from 16:00 on the day of departure; return by 11:00 at the latest on the day of return.

These times may be adjusted by mutual written agreement at no extra charge when scheduling allows. Pick-up or return outside the agreed slots must be announced at least 48 hours in advance.

7.2. Condition report

A joint condition report is drawn up at pick-up and return, in the presence of the renter and the lessor. It covers the exterior and interior condition, levels (fuel, water, gas), mileage, inventory and accessories. It is signed by both parties and is binding between them.

The renter has the duration of the handover to report any pre-existing defect or damage. After signing the pick-up condition report, any unrecorded damage is presumed to have occurred during the rental, unless proven otherwise.

Defects and damage are marked on the vehicle diagram in annex 3 to the rental contract, numbered and described in the accompanying table: blue pen at pick-up, red pen at return. Both parties photograph the vehicle at pick-up and return.

7.3. Return at night or in bad weather

Where return takes place in the dark, in heavy rain, in snow, or when the vehicle is covered in mud, sand or frost, the parties expressly note this on the return condition report, which both sign. The lessor photographs the vehicle in the condition in which it is returned.

In that case only, the lessor has a 48-hour reserve period from return to notify the renter, in writing and with supporting photographs, of damage to the bodywork, glazing, roof or exterior equipment that was objectively not detectable at the time of the condition report. After that period, no further damage may be claimed and the return condition report is final.

During that period, the vehicle is neither repaired, re-rented nor put back into circulation before inspection. The exterior cleaning necessary for that inspection is documented by dated photographs before and after washing.

The renter is given at least 12 hours' notice of the time of the inspection and may attend or be represented. If they cannot or do not wish to attend, the inspection takes place in their absence and the dated photographs are sent to them the same day.

This reservation does not reverse the burden of proof: it is for the lessor to establish that the reported damage occurred during the rental. The renter then has the 14-day observation period provided for in Article 6, and no amount may be deducted from the security deposit before that procedure is completed.

7.4. Late return

Each started hour of delay is charged €25, up to a maximum of 3 hours. Beyond 3 hours' delay, a total flat fee of €140 applies instead of the hourly charge. This compensation does not prevent recovery of any additional loss actually suffered and duly substantiated, in particular if the next rental must be cancelled or shortened. The renter must immediately notify the lessor of any foreseeable delay.

7.5. Failure to return

If the vehicle is not returned within 12 hours of the agreed time and there is no news from the renter, the lessor is entitled to declare the vehicle misappropriated and to file a complaint. The renter then bears the financial consequences actually charged to the lessor as a result of that failure to return, including, where applicable, any exclusion or reduction of cover or any claim by the insurer that is duly substantiated (Article 13.2). Misappropriation of the vehicle remains covered by the insurer, but subject to an excess of 6% of the vehicle's list value exclusive of VAT, with a minimum of €3,000, which remains at the renter's expense.

Article 8

Use of the vehicle

8.1. General obligations

The renter uses the vehicle in a careful, reasonable and diligent manner, in accordance with the highway code and the instructions received at handover. They must in particular:

  • never exceed the maximum authorised mass or the number of 5 people on board, each seated and belted while driving;
  • regularly check fluid levels (oil, coolant, screenwash, AdBlue) and tyre pressure;
  • always allow for the vehicle's height of 2.90 m and length of 6.36 m;
  • lock the vehicle at every stop, including for a brief absence, never leave the keys or vehicle documents inside, and not leave visible valuables inside. A vehicle left unlocked, or with an opening (boot, window, rooflight, roof) left unclosed, is not covered against theft;
  • lock the rooflights and windows before any journey, and in wind or rain;
  • protect the water system from frost in winter, following the instructions given.

8.2. Prohibitions

It is strictly prohibited:

  • to entrust the wheel to a person who is not an approved driver under the contract;
  • to sublet, lend, assign or make the vehicle available to third parties in any way whatsoever;
  • to carry people or goods for payment or for professional purposes;
  • to carry dangerous, flammable or illicit goods;
  • to take part in any race, competition, rally, trial or contest, whether authorised or not;
  • to drive on unmade tracks, trails, sand, beaches or off the public road network open to traffic;
  • to smoke or vape inside the vehicle;
  • to use the vehicle while intoxicated, under the influence of drugs, medication or any substance impairing the ability to drive;
  • to modify the vehicle, its fittings or electronics, or to drill, glue or attach anything to it;
  • to use gas appliances while driving, in a tunnel or on a ferry;
  • to empty waste water or the toilet cassette outside designated facilities.

8.3. Animals

Animals are allowed subject to prior written agreement by the lessor, noted in the contract, and payment of an additional cleaning fee of €50. The animal must never be left alone in the vehicle and must not go on bedding or seats.

Article 9

Washing and cleaning the vehicle

Under no circumstances may the vehicle be washed in a car wash, whether automatic (rollers, gantry) or manual (high-pressure lance). Such facilities carry a significant risk of damage to the bodywork and exterior equipment, as well as water ingress at windows, bays, rooflights, ventilation grilles, the water filler hatch and any other opening.

The interior of the vehicle may not be cleaned using large amounts of water (bucket of water poured out, hose, pressure washer, wet vacuum). Only dry cleaning or a slightly damp cloth is permitted, failing which the electrical circuits, wall panels and insulation may be damaged.

Any damage resulting from a breach of these prohibitions is entirely at the renter's expense.

Article 10

Permitted geographical area

The vehicle may be driven in Belgium and in the countries of the European Union and the European Economic Area, as well as in Switzerland and the United Kingdom, provided these countries appear, not crossed out, on the international insurance card (green card) supplied with the vehicle. Turkey is excluded in all circumstances.

The renter declares in the rental contract the countries they intend to cross and their destination. Any travel outside the authorised area is prohibited and forfeits the benefit of insurance cover; it may give rise to the immediate termination provided for in Article 18.

Transport of the vehicle by ferry, shuttle or train is allowed subject to prior notice to the lessor.

The renter must inform themselves of local rules applying to high vehicles (low-emission zones, vignettes, parking and wild camping restrictions) and bears the consequences alone.

Article 11

Mileage, fuel, gas and sanitation

11.1. Mileage

The allowance includes 150 km per rental night, cumulative over the whole trip. Excess kilometres are charged at €0.45 per kilometre on return, based on the odometer reading at the condition reports. Any tampering with the odometer results in a flat charge of 500 km per rental night, without prejudice to prosecution and proof of a greater loss.

11.2. Fuel and AdBlue

The vehicle is supplied with a full tank of fuel and must be returned full. Otherwise, missing fuel is charged at pump price plus a €25 fee for the journey.

The vehicle runs on diesel and requires AdBlue. Any misfuelling remains entirely at the renter's expense: drain, system cleaning, recovery, immobilisation; this damage is not covered by insurance.

11.3. Gas, water and sanitation

One gas bottle is supplied. Its normal consumption during the rental is included in the price: the renter does not have to replace it solely because of that consumption. Loss or damage to the bottle, or clearly abnormal consumption resulting from non-compliant use, remains at their expense.

The vehicle is returned with the toilet cassette emptied and rinsed, waste water drained, fridge emptied and defrosted, and the interior tidy and swept. The covers routine cleaning, not restoring a vehicle returned dirty or soiled (rate schedule).

Article 12

Maintenance, breakdowns and repairs

The renter is responsible for routine maintenance of the vehicle during the rental: checking and topping up levels, tyre pressure, cleanliness.

In the event of a breakdown, fault, warning light or unusual noise, the renter must stop as soon as safely possible and contact the lessor immediately. They must not continue if safety or the condition of the vehicle is at risk.

No repair, recovery or towing may be arranged without the lessor's prior written agreement. Costs incurred without that agreement are not reimbursed. Authorised repairs are reimbursed on presentation of the original invoice made out in the lessor's name.

Breakdowns resulting from normal wear or a defect in the vehicle are at the lessor's expense. Breakdowns resulting from fault, negligence or non-compliant use by the renter are at their expense, including recovery, repatriation and immobilisation costs.

If immobilisation of the vehicle for a reason attributable to the lessor prevents the trip from continuing, the renter is refunded pro rata for unused nights. This compensation constitutes flat-rate compensation for the loss and cannot exceed the total rental amount.

Article 13

Insurance

13.1. Cover during the rental

During the rental, the vehicle benefits from compulsory motor third-party liability and comprehensive insurance taken out by the lessor. The renter is informed before booking of the applicable cover, the normal excess and the main exclusions.

During the rental period, the lessor's covers include:

  • compulsory third-party liability (damage caused to third parties);
  • comprehensive (material damage to the vehicle), subject to the normally applicable excess.

Cover is subject to compliance with the insurability and use conditions set out in particular in Articles 3, 8 and 10, as well as the insurer's conditions.

13.2. Excesses payable by the renter

SituationExcessAmount payable by the renter
Material damage to the vehicle (comprehensive)Normal excess€1,115.70
Claim with an unapproved driverAdditional excesses+ €250 third-party and + €500 comprehensive
Misappropriation of the vehicle (failure to return)Specific excess6% of list value exclusive of VAT, minimum €3,000
Fraud, false declaration or breach of insurability conditionsNot applicableFull liability, without cap

The normal excess is payable per claim; additional excesses are added to it. The amount of the normal comprehensive excess corresponds to 2% of the vehicle's value exclusive of VAT, with a minimum of €1,000, and currently stands at €1,115.70. Payment of this excess does not release the renter from the consequences of fraud, a false declaration or a breach of insurability conditions. Where the insurer refuses or reduces its intervention or brings a claim against the lessor because of a fact attributable to the renter or a driver, the renter reimburses the amounts actually charged to the lessor and duly substantiated. The €2,000 security deposit does not constitute a liability cap.

Where the renter is not responsible for a claim but the responsible third party has not yet been identified or the lessor has not yet obtained compensation, the excess may be retained provisionally. It is refunded to the renter once effectively recovered from the third party or their insurer.

13.3. Personal covers not included

Essential point — read carefully

During the rental, the personal covers of the renter and passengers such as legal protection, driver personal accident, baggage insurance and personal assistance are not included in the lessor's motor covers.

It is for the renter to take out, in their own name and at their own expense, any additional cover they consider necessary, in particular cancellation insurance, driver personal accident, legal protection, baggage or personal assistance.

The lessor strongly recommends that the renter check the scope of their own policies (travel assistance, credit card, health insurance mutual) before departure.

13.4. VAB assistance for the benefit of the renter

The lessor makes available VAB assistance, the exact scope of which is defined in a separate assistance amendment. That amendment specifies in particular the beneficiaries, geographical area, benefits, caps, exclusions and applicable options. It is communicated to the renter before the booking is concluded and annexed to the rental contract; its provisions prevail for everything concerning VAB assistance.

VAB assistance amendment

The renter acknowledges that only the version of the amendment provided before booking and annexed to the contract determines the beneficiaries, benefits, limits, exclusions, options and territories covered.

The assistance included in the price within the meaning of Article 5.2 also includes telephone assistance from the lessor for questions on use of the vehicle. It replaces neither the VAB assistance described in the amendment nor personal insurance taken out by the renter.

13.5. Exclusions

The following situations may, depending on the insurer's conditions, lead to exclusion or reduction of cover or a claim by the insurer. To that extent, the financial consequences actually borne by the lessor and duly substantiated remain at the renter's expense, without payment of the normal excess or the security deposit constituting a cap:

  • damage occurring while the vehicle was driven by an unapproved person, without a valid licence or while disqualified;
  • damage occurring under the influence of alcohol, drugs or medication incompatible with driving, as well as in the event of hit-and-run;
  • intentional damage and gross negligence;
  • damage resulting from use prohibited by Article 8.2 or from travel outside the area authorised under Article 10;
  • damage following a false declaration by the renter;
  • theft occurring while the vehicle was unlocked, an opening was left unclosed, the keys were inside, or which was not the subject of a police report within 48 hours (Article 14).
Article 14

Accident, theft, claim: what to do

  • first ensure the safety of people and call emergency services if necessary;
  • notify the lessor immediately, and in any event within 24 hours, by phone then in writing;
  • complete a European accident statement signed by all parties, record the third party's details and insurer and those of witnesses;
Police report within 48 hours: mandatory obligation

In the event of theft, attempted theft, theft of the keys, vandalism, collision with game or another stray animal, personal injury, dispute or no identified third party, the renter has the facts recorded by the competent police authorities and files a police report within 48 hours of the occurrence of the facts. They transmit without delay to the lessor the official report or the acknowledgement of the complaint.

This obligation is imposed by the vehicle's insurance contract: failing a police report filed within that period, the insurer refuses cover and the entire loss remains at the renter's expense, without any limit on amount.

  • photograph damage, vehicles involved and the scene;
  • do not admit liability in any way and do not enter into negotiations with the third party or their insurer;
  • do not have any repair carried out without the lessor's written agreement;
  • hand over to the lessor on return all documents relating to the claim.

In the event of theft by break-in, all vehicle keys are handed to the lessor; in the event of theft with violence or break-in of the place where the keys were kept, the spare key is handed over. Their absence prevents the insurer's intervention, in which case the loss remains at the renter's expense. In the event of loss or theft of the keys, the renter notifies the lessor immediately: the insurer requires that lock replacement take place within one business day. The renter assists the police and the insurer in searching for the perpetrator and recovering the vehicle.

Failure to comply with the obligations in this article, if it causes loss to the lessor or forfeits cover, makes the renter liable for all consequences.

Article 15

Fines, offences and administrative fees

All fines, parking charges, unpaid tolls, taxes and administrative penalties relating to events during the rental are solely at the renter's expense, even if they reach the lessor after the rental ends.

The lessor is required to disclose the driver's identity to the authorities and does so without delay. An administrative fee of €25 per file is charged. In the event of a serious offence likely to lead to seizure or immobilisation of the vehicle, the renter bears all recovery, storage and immobilisation costs, as well as the lessor's loss of use.

Article 16

Renter's liability

The renter is responsible for the vehicle, its equipment, accessories and inventory from handover of the keys until actual return and signing of the return condition report.

The following remain at their expense in particular, without this list being exhaustive:

  • damage to the roof panel, roof, solar panels and rooflights resulting from height impact (barrier, petrol station canopy, branch, gantry, covered car park);
  • damage to the awning, blinds, steps, doors and their mechanisms;
  • damage to the underbody, tanks and wheels caused by an obstacle, kerb or unmade track;
  • interior damage: burns, permanent stains, tears, breakage of furniture, bedding, crockery and equipment;
  • damage to the water system caused by frost, for failure to follow winterisation instructions;
  • damage resulting from washing in a car wash or from interior cleaning with large amounts of water (Article 9);
  • misfuelling, overheating, abusive use of clutch or gearbox;
  • loss or damage to keys, vehicle documents, electric cable, chocks, hoses and accessories;
  • exceptional cleaning, deodorising and restoration after breach of the no-smoking rule.

Missing or damaged items are charged at replacement value, plus labour and travel costs, on quote or invoice.

Article 17

Cancellation and changes

17.1. Cancellation by the renter

Any cancellation must be notified by email. The date of receipt determines the applicable scale, calculated on the total rental amount.

Cancellation receivedRetention
More than 60 days before pick-up0% of the total amount
60 to 31 days before pick-up30% of the total amount (i.e. the deposit)
30 to 15 days before pick-up50%
14 to 7 days before pick-up75%
Less than 7 days, or no-show100%

If the lessor succeeds in re-renting the vehicle for all or part of the cancelled period, the corresponding amounts are refunded, less an administrative fee of €50. Early return, late arrival or interruption of the trip by the renter gives no right to a refund. Taking out personal cancellation insurance is strongly advised.

17.2. Date changes

Allowed once, at no charge, if requested more than 30 days before pick-up and if scheduling allows. Beyond that, it is treated as a cancellation followed by a new booking.

17.3. Cancellation by the lessor

If the vehicle becomes unavailable before pick-up for a reason beyond the lessor's control (claim, major breakdown, damage by a previous renter, immobilisation, force majeure), the lessor informs the renter without delay and offers, at the renter's choice: postponement of the trip to equivalent dates, or full and immediate refund of all amounts paid.

Article 18

Immediate termination

The lessor may terminate the rental with immediate effect and retake possession of the vehicle, without refund or compensation, in the event of a false declaration by the renter, driving by an unapproved person, prohibited use within the meaning of Article 8.2, travel outside the authorised geographical area (Article 10), failure to pay the balance or provide the deposit, or manifest endangerment of the vehicle or the safety of persons. Recovery costs are at the renter's expense.

Article 19

Personal belongings and force majeure

Personal effects, luggage, devices and valuables carried are not insured by the lessor, who declines all liability in the event of loss, theft or damage, including for items forgotten after return.

Neither party is liable for failure to perform its obligations resulting from force majeure: natural disaster, exceptional weather event, border closure, decision by the authorities, fuel shortage, armed conflict, epidemic. The parties then consult in good faith on postponement or, failing that, on refund of services not performed.

Article 20

Right of withdrawal

Under Article VI.53, 12° of the Code of Economic Law, the 14-day right of withdrawal does not apply to distance contracts for vehicle rental providing for a fixed date or period of performance. The booking is therefore firm from confirmation, and only the cancellation terms in Article 17 apply. The renter is informed of this and expressly accepts it.

Article 21

Personal data

The data controller is Lalouque SRL (trading as Pyja Van), Rue de la Grande Ferme 11, 1350 Orp-Jauche — contact@pyjavan.be.

The lessor processes data of the renter and drivers (identity, contact details, date of birth, driving licence number and date, double-sided copies of identity documents and licences required by the insurer, declarations contained in the claims and driving history attestation, declared destination and billing data) solely to conclude and perform the contract, verify the insurability conditions imposed by the insurer, manage claims, fines and billing, and comply with legal and accounting obligations.

These processing activities are limited to what is necessary for the purposes above. Documents and declarations required by the insurer are collected at its express request. Where certain information is subject to enhanced protection, it is processed and disclosed only to the extent strictly necessary to verify insurability and manage a possible claim.

21.1. Recipients, retention and rights

Data may be disclosed to the insurer, broker, assistance service and competent authorities. They are neither sold nor used for marketing without consent.

Copies of identity documents and licences are kept for the duration of the rental and one year afterwards, unless a claim or dispute is ongoing. Contractual and accounting data are kept for 10 years.

The renter has rights of access, rectification, erasure, restriction, objection and portability, to be exercised by email at contact@pyjavan.be. They may lodge a complaint with the Data Protection Authority (rue de la Presse 35, 1000 Brussels — www.autoriteprotectiondonnees.be). Further information is also set out in the legal notice and privacy policy.

Article 22

Complaints, applicable law and disputes

Any complaint should be sent by email to contact@pyjavan.be. The lessor undertakes to reply within 14 days.

If no amicable solution is reached, the consumer renter may refer the matter free of charge to the Consumer Mediation Service, Boulevard du Roi Albert II 8 box 1, 1000 Brussels (www.mediationconsommateur.be).

The contract is governed by Belgian law. In the event of a dispute, the competent courts are those designated by the Judicial Code; for a consumer renter, this includes notably the court of their domicile. If any clause were declared void or unenforceable, the others would remain in full force.

Schedule of supplements and flat fees

These amounts correspond to a flat-rate estimate of the costs normally caused by the situation concerned. They may be deducted from the security deposit according to the procedure in Article 6. The flat fee is set off against the loss actually suffered; if the proven loss is higher, only the additional balance duly substantiated may be claimed.
